Welcome to Design Beyond Games. These Terms of Service (“Terms”) govern your use of our website and the purchase of our professional consulting services. By booking a session or purchasing a service, you agree to these Terms.

1. The Service Provider

The services are provided by Mikado Effects Ltd., a company registered in Bulgaria with VAT 206983011 (referred to as “the Consultant”, “we”, or “us”).

2. Nature of Consulting Services

The Consultant provides professional advisory services based on game design thinking, including project audits, system design, and strategic consulting.

• Advisory Only: Our services are advisory in nature. We provide recommendations and frameworks, but the final implementation and results of these recommendations are the sole responsibility of the Client.
• No Professional Guarantees: While we strive for excellence, we do not guarantee specific financial outcomes, revenue increases, or project success metrics, as these depend on the Client’s execution and external market factors.

3. Booking and Payments

• Payment: All services must be paid for in advance through our authorized reseller, or by bank statement.
• Cancellations: For live consultation sessions, please provide at least 24 hours’ notice for rescheduling. Cancellations made less than 24 hours before a scheduled session may not be eligible for a refund.

4. Intellectual Property

• Consultant IP: We retain all rights, titles, and interests in our proprietary methodologies, game design frameworks, and any materials developed prior to or independently of our engagement.
• Client Deliverables: Upon full payment, the Client is granted a non-exclusive, perpetual license to use the custom reports or blueprints created specifically for them for their internal business purposes.

5. Confidentiality

Both parties agree to treat all non-public information, project details, and business data shared during the consulting process as strictly confidential. We will not disclose your project details to third parties without your written consent, except as required by law.

6. Limitation of Liability

To the maximum extent permitted by Bulgarian law, the Consultant’s total liability for any claim arising out of these Terms or our services shall not exceed the total amount paid by the Client for the specific service in question.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bulgaria.
